Auckland City Council
The iwi Ngāi Tahu and the Auckland Council were called to negotiate the Treaty at Waitangi in 1840, which led to the Treaty of Waitangi being signed in 1840. The Treaty is the founding document of the relationship between the Government and the Māori and determines the rights and responsibilities of those involved and future generations. The Treaty was never signed by the Crown until 1984.
Treaty Tenders
In the 1840s, the Natives Land Court was set up by the colonial government, to handle the settlement of land claims (for which land were to be allocated in blocks of 500 square acres) and Māori were given a right to purchase land in payment for loans taken from the courts by the government. From 1840 to the 1870s, most of the large landblocks, mainly in northern and central North Island, were distributed under the provisions of the Treaty, but this system was only a partial remedy to the economic situation. Poor management of public works (the main beneficiaries of the land were often the land speculators who were invested in land development), lack of incentive in public works, and especially the large land grants to settler communities, all weakened the process.
Other significant issues included Māori and colonisers each having vastly different concepts of the land and their use. Other disagreements were based on the Māori discontent of constant loss of land and initial land purchases being smaller than expected, and the lack of an effective Maori voice in the negotiation.
Prior to the 1950s, only about 40,000 hectares in the North Island were owned by Māori. In 1951, a Bill was passed for a tribal government to be set up in the North Island. The Māori Land Commissioner was charged with the responsibility for selling off unutilised land. The government spent about $16m on compensation for Māori and in 1977 the Maori Affairs Department replaced the Land Commissioner with a Minister of Maori Affairs.
